Qualex Terms of Use
These terms explain how you may use Qualex, including accounts, resume analysis, paid plans, Analysis Pack purchases, refunds, account restrictions, and account deletion.
1. Who We Are
Qualex is operated by Individual Entrepreneur Andrii Dmytrovych Mahas, registration/tax ID Tax ID 3885812390, located in Ukraine. You can contact us at [email protected].
Payments, invoices, taxes, and payment processing may be handled by Paddle as the official seller (merchant of record) for paid purchases. Paddle may also apply its own payment, tax, invoice, and buyer terms.
2. Eligibility
You must be at least 18 years old to create an account or purchase paid access. By using Qualex, you confirm that you meet this requirement and that the information you provide is accurate.
3. The Service
Qualex helps users upload resumes, add role-related context, and keep resume text review results, saved result cards, labels, private notes, source files, and exports in a workspace. The Service can point to text snippets that appear relevant to role requirements, unclear points, and requirements not found in the uploaded text. It is a document workflow and organization tool for human review.
Qualex does not compare applicants with each other, rank people, approve or reject anyone, decide who should be hired or interviewed, or make employment decisions. Any next step, label, note, message, interview decision, hiring decision, or rejection decision is made by the user outside the Service.
You may use Qualex for personal, professional, or business recruiting purposes. If you use the Service on behalf of an organization, you confirm that you are authorized to do so and that you have the necessary rights and permissions for the resumes, role descriptions, and related data you upload.
4. Accounts and Security
- You are responsible for keeping your account, email inbox, verification codes, and devices secure.
- You must not share login codes, bypass authentication, or allow unauthorized access to your account.
- We may use verification codes, trusted-device cookies, Turnstile or similar anti-abuse checks, rate limits, and security logs to protect the Service.
- You must notify us promptly if you believe your account was accessed without permission.
5. Resumes and Your Responsibilities
Resumes and role-related materials may contain personal data and sometimes sensitive information. You must only upload data that you are legally allowed to upload and process. This may require consent, a legitimate interest, contractual necessity, or another lawful basis depending on your role, country, and use case.
- You are responsible for giving any notices or obtaining any permissions required from the relevant individuals or other data subjects.
- You must not upload resumes, files, or content that you obtained unlawfully or are not allowed to process.
- You must not upload data about children, special-category data, or highly sensitive data unless you have a clear legal basis and the upload is necessary for your lawful use of the Service.
- You remain responsible for all human review, communications, labels, notes, hiring steps, rejection steps, and employment decisions.
6. Assisted Output and Human Review
Assisted output may be incomplete, inaccurate, biased, outdated, or unsuitable for your specific context. You must review all result cards, snippets, labels, notes, and exports before relying on them. You must not use Qualex as the sole basis for decisions that produce legal or similarly significant effects for a person.
You must not use the Service to infer or decide a person's culture fit, protected traits, health, beliefs, personality, social status, ethnicity, religion, political views, union membership, sexual orientation, or other sensitive or legally protected characteristics. You are responsible for complying with employment, equality, anti-discrimination, privacy, and recruiting laws that apply to your use of the Service.
Where included in the active plan, assisted output may include AI-generated follow-up questions based on the role requirements and CV text. These questions may omit context or require adjustment and must be reviewed before use. You must not use them to request unlawful or legally protected information.
7. Paid Plans and Analysis Packs
Paid plans provide additional monthly resume-document analysis capacity, role-workspace limits, saved result card limits, source-file retention where included, private notes, exports, and other features shown on the pricing and payment pages. Supported plan names include Free, Starter, Basic, and Pro. Paid subscriptions may be offered monthly or quarterly and renew automatically unless cancelled.
Analysis Pack is a one-time digital add-on that adds 300 additional resume analyses to your account after successful payment. These analyses are used only after your monthly plan analysis limit is exhausted. They do not expire while your account remains active, but they have no cash value, are not transferable, and are permanently removed if your account is deleted. Your additional analysis balance cannot exceed 3,000, and you may purchase at most 10 Analysis Packs during a rolling 14-day period, subject to the balance cap.
7A. Result Cards and Source Files
Result cards are kept with their role workspace. On Free and Starter plans, source resume files are not attached to those cards and are removed after processing. Basic and Pro plans may retain the related source files with result cards for the applicable retention period.
8. Payments, Renewal, and Cancellation
- Paid access begins immediately after successful payment.
- Subscription prices, payment cycles, taxes, and available payment methods are shown on Paddle's payment page.
- You can request cancellation of the next subscription renewal from your account where the feature is available.
- Canceling a future renewal stops future renewal charges; it does not by itself refund a charge already paid.
- After cancellation of renewal, paid access may continue until the paid period ends unless access is cancelled immediately due to refund approval, account deletion, account restriction, a bank payment dispute (chargeback), fraud, or another permitted reason.
- When we approve a refund request, we may immediately cancel the linked subscription and move the account to the Free plan. Where technically possible, we initiate the refund through Paddle.
8A. Overdue Payments and Recovery
An automatically collected subscription payment may fail. If Paddle marks the subscription as overdue, we temporarily limit paid activity. You may view existing data and open Payment Details to update your payment method, but cannot start new resume analysis, buy an Analysis Pack, initiate another plan change, or otherwise increase paid use while payment recovery is in progress.
Paddle may retry the payment under its recovery settings. If payment succeeds, the same subscription becomes active again and paid access resumes. If recovery is exhausted or the subscription is canceled, the account moves to Free and data beyond the available plan limits may be temporarily frozen and later deleted under the Privacy Policy. Payment recovery does not guarantee continued access or start a new free trial.
9. Refunds
Refund requests are governed by our Refund Policy. Refund requests must be made in good faith and may be declined if the paid service was used beyond the policy limits, if the request is abusive, or if the request does not meet the policy conditions. Nothing in these Terms or the Refund Policy limits any mandatory rights you may have under applicable law.
10. Account Deletion
You may request account deletion from your profile, subject to security checks. Deleting your account permanently removes your workspace data, role workspaces, uploaded files, saved result cards, private notes, exports, the additional analysis balance, trusted devices, and active sessions.
Before deletion, any active Paddle subscription linked to the account must be cancelled immediately. If we cannot cancel it, the account will not be deleted and you should try again or contact support. We may retain limited payment, tax, consent, fraud-prevention, and legal records where required or permitted by law.
Account deletion may be paused while a payment session or payment is still being finalized. If a payment completes after deletion is requested, we may need to cancel the associated subscription or handle the purchase or refund with Paddle and support before deletion can be completed.
After deletion, questions about payments or refunds can only be handled through support using your Paddle receipt, transaction ID, or other sufficient proof of purchase. We do not send a separate post-deletion email with transaction IDs. The email address from the deleted account cannot be used to create another Qualex account during the retention period described in our Privacy Policy.
11. Account Restrictions
We may restrict, suspend, or terminate accounts to protect the Service, enforce these Terms, respond to abuse, prevent fraud, comply with law, or investigate suspicious activity. When an account is restricted, access to the product is blocked, payment pages and uploads are blocked, and we may request cancellation of the next subscription renewal. Existing refund requests may remain available for manual admin review.
If your account is restricted and you want to request restoration, deletion, or help with payments or refunds, contact [email protected]. We aim to respond within a few business days.
12. Prohibited Use
- Do not use the Service for unlawful, discriminatory, harmful, deceptive, or abusive purposes.
- Do not upload files or data that you have no right to process.
- Do not use the Service to make automated hiring, rejection, ranking, approval, compensation, or employment decisions about a person.
- Do not use the Service to infer protected traits, culture fit, personality, health, beliefs, or other sensitive characteristics.
- Do not attempt to bypass quotas, payment checks, security controls, rate limits, or account restrictions.
- Do not scrape, copy, reverse engineer, attack, overload, or interfere with the Service.
- Do not submit malicious software, malicious files, prompt-injection attacks, or content intended to manipulate, extract data from, or damage the system.
- Do not resell, sublicense, or provide access to the Service as a competing product without our written permission.
- Do not abuse refunds, payment disputes (chargebacks), free trials, Analysis Pack purchases, or subscription changes.
13. Intellectual Property
We and our licensors own the Service, software, design, branding, workflows, and related materials. You retain rights to the files, resumes, role descriptions, and other content you upload. You grant us the limited rights needed to host, process, organize, secure, display, and provide the Service to you.
14. Third-Party Services
The Service relies on third-party services such as Paddle for payments, Brevo for email delivery, Google Cloud/Vertex AI/Gemini for resume text processing, Cloudflare Turnstile or similar tools for anti-abuse, and hosting/database providers such as Contabo GmbH, Cloud VPS 30 NVMe, Hub Europe / European Union. Third-party services may be subject to their own terms and privacy notices.
15. Availability and Changes
We may improve, change, limit, suspend, or discontinue parts of the Service. We try to keep the Service reliable, but we do not guarantee that it will always be uninterrupted, error-free, or available in every country or environment.
16. Disclaimers and Liability
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We do not guarantee that assisted output, text snippets, requirement matches, labels, notes, exports, or reports will be accurate, complete, unbiased, or suitable for any particular workflow, hiring step, or employment decision.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including mandatory consumer rights, fraud, intentional misconduct, or other liability that cannot be excluded under applicable law.
17. Changes to These Terms
We may update these Terms when the Service, legal requirements, pricing, policies, or business needs change. The effective date will show when the current version applies. If a change materially affects your rights or paid access, we will take reasonable steps to notify you.
18. Governing Law and Contact
These Terms are governed by the laws of Ukraine. Mandatory consumer protection rules in your country may still apply where the law requires them.
If these Terms, the Privacy Policy, or the Refund Policy are translated, the English version is the primary version unless applicable law requires otherwise.
